This document outlines the terms and conditions governing the rental of self-drive vehicles from Mumbai self drive (hereinafter referred to as "Company", "we", "us"). By making a booking or using our services, you (hereinafter referred to as "Customer", "Renter", "you") acknowledge and agree to be bound by these terms.
1. Eligibility Requirements
- Age: Renter must be minimum 21 years of age.
- Driving License: Must possess a valid Indian Driving License (LMV - Light Motor Vehicle) held for at least 1 year prior to the rental start date. The license must be valid for the entire rental duration.
- ID & Address Proof: Must provide original, valid government-issued ID proof (e.g., Aadhar Card, Passport) and current address proof (e.g., recent utility bill matching ID address, or valid rental agreement).
- International Renters: Must possess a valid driving license from their home country along with a valid International Driving Permit (IDP). Original Passport and valid Indian Visa are also required.
- Verification: The Company reserves the right to verify all documents and refuse rental if eligibility criteria are not met or documents appear invalid/tampered with.
2. Booking, Payment & Security Deposit
- Booking Process: Bookings are typically initiated via WhatsApp (+91 82863 02414) or phone call (+91 82863 02414) and are confirmed only upon successful document verification and advance payment realization. All bookings are subject to vehicle availability.
- Rental Charges: Calculated on a 24-hour cycle from the agreed pickup time, unless a specific hourly/weekly/monthly plan is agreed upon. Minimum rental periods may apply.
- Advance Payment: Full estimated rental charges must be paid in advance to confirm the booking.
- Security Deposit: A refundable security deposit is required for most rentals. The amount varies based on the car model, rental duration, and Renter profile. Zero deposit options may be available for select vehicles under promotional offers or specific criteria, communicated during booking. The deposit is refunded after the vehicle is returned, inspected for damages, and all dues (fuel, tolls, fines etc.) are cleared, typically within 5-7 working days.
- Exclusions: Rental charges exclude fuel, tolls, parking fees, interstate taxes/permits, traffic violation fines, and any damage/repair costs not covered by insurance or falling within the deductible.
3. Vehicle Usage & Restrictions
- Authorized Driver(s): Only the Renter whose documents have been verified is permitted to drive the vehicle. Additional drivers may be permitted subject to document verification and potential additional charges, as agreed upon in advance.
- Prohibited Uses: The vehicle shall not be used for: (a) any illegal purpose; (b) racing, speed tests, or competitions; (c) towing other vehicles/trailers; (d) transporting goods or passengers for hire (unless specifically permitted for commercial use vehicles); (e) carrying hazardous, inflammable, or prohibited substances; (f) driving on unpaved roads or areas unsuitable for the vehicle; (g) subletting to any third party.
- Intoxication: Driving under the influence of alcohol, drugs, or any intoxicating substance is strictly prohibited and illegal. Doing so will void all insurance coverage and make the Renter fully liable for all damages and legal consequences.
- Geographical Limits: While generally permitted within India, Renters must inform the Company of intended travel outside Maharashtra state borders. Renter is solely responsible for obtaining and paying for necessary interstate permits, taxes, and tolls.
- Traffic Laws: Renter must strictly adhere to all applicable traffic laws, speed limits, and regulations of the Republic of India and the specific states travelled through. All fines or penalties incurred due to traffic violations are the Renter's responsibility.
- Vehicle Care: Smoking inside the vehicle is strictly prohibited. A cleaning fee will be charged if this rule is violated. Renters are expected to maintain reasonable cleanliness.
4. Vehicle Handover, Return & Condition
- Pickup Inspection: Renters must inspect the vehicle thoroughly at pickup, note any existing damages/scratches on the checklist provided (if any), and preferably take photographs/videos for record.
- Responsibility: The Renter is responsible for the vehicle's safety and security from the time of pickup until its return to the Company.
- Damage Liability: Renter is liable for any new damage (interior/exterior), loss, or theft of the vehicle or its parts/accessories during the rental period. This liability is subject to the terms of the insurance policy and the applicable damage deductible (excess) amount, which will be communicated. Minor scratches might incur specific charges.
- Return Schedule: The vehicle must be returned at the agreed-upon date, time, and location.
- Late Return: Delays beyond a grace period (if any, specified by the Company) will incur late fees, potentially charged at the daily or hourly rate, as applicable. Please inform us in advance if a delay is anticipated.
- Cleanliness: Return the vehicle in a reasonably clean state. Excessive soiling (e.g., mud, food stains, spills) may result in cleaning charges deducted from the security deposit.
5. Fuel Policy
- The vehicle will be provided with a noted fuel level (e.g., full tank, half tank).
- The Renter must return the vehicle with the same fuel level.
- If returned with less fuel, the cost of the deficit fuel (at prevailing market rates) plus a refueling service charge will be deducted from the security deposit or charged separately.
- No refund or credit is provided for returning the vehicle with excess fuel.
6. Insurance, Accidents & Breakdown
- Insurance Coverage: Vehicles are covered by comprehensive motor insurance as required by Indian law, typically including third-party liability and own damage cover, subject to policy terms and conditions.
- Damage Deductible: In case of damage to the rental vehicle, the Renter is liable to pay a mandatory damage deductible amount (also known as excess). This amount will be specified in the rental agreement or communicated during booking. Costs exceeding the deductible may be covered by insurance, provided terms are not violated.
- Accident Procedure: In case of an accident: (a) Ensure safety of all involved. (b) Do not leave the vehicle unattended. (c) Immediately inform Mumbai self drive (+91 82863 02414). (d) Immediately inform the nearest Police Station and file an FIR (First Information Report). (e) Cooperate fully with the Company and insurance surveyors. Failure to follow these steps may void insurance coverage.
- Breakdown Assistance: We provide 24/7 roadside assistance. In case of mechanical failure, contact our support number immediately. Do not attempt repairs from unauthorized mechanics.
- Insurance Voidance: Insurance cover becomes void if the vehicle is used in violation of these terms (e.g., drunk driving, illegal use, unauthorized driver, racing, outside permitted geographical limits without notice). In such cases, the Renter becomes liable for the *entire* cost of damage/loss.
7. Cancellation and Modification
- Cancellation Policy: Charges may apply for cancellations depending on how much notice is given before the rental start time. Specific charges (e.g., percentage of booking amount) will be communicated during the booking process or upon request.
- Modifications: Requests to modify booking dates, times, or vehicle type are subject to availability and may result in changes to the rental rate or applicability of new terms.
- No Show: Failure to pick up the vehicle at the agreed time without prior notification may be treated as a cancellation with applicable charges.
8. Privacy Policy
- We collect necessary personal information (name, contact details, license, ID proofs) for booking, verification, insurance, and service provision. We are committed to protecting your privacy and handling your data responsibly in accordance with applicable data protection laws. We do not sell your data to third parties for marketing purposes.
9. Limitation of Liability
- The Company shall not be liable for any loss or damage to the Renter's personal belongings left inside the vehicle.
- The Company's total liability for any claim arising out of the rental agreement shall be limited to the total rental amount paid by the Renter, except where mandated otherwise by law.
- The Company is not liable for any indirect or consequential losses incurred by the Renter due to vehicle breakdown or unavailability, although we will make reasonable efforts to provide assistance or alternatives.
10. Governing Law and Dispute Resolution
- These Terms and Conditions and the rental agreement shall be governed by and construed in accordance with the laws of India.
- Any dispute, controversy, or claim arising out of or relating to this agreement shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra.
11. Amendments
- Mumbai self drive reserves the right to amend these Terms and Conditions at any time without prior notice. The terms and conditions prevailing at the time of booking confirmation will apply to that specific rental agreement.
